The Metolong Authority (MA) is implementing the Metolong Dam and Water Supply Programme with the objective to supply potable water for domestic and industrial use to the capital city Maseru, the towns of Roma, Mazenod, Morija and the town of Teyateyaneng (TY).
The programme is composed of five major construction contracts, namely, Metolong Dam and Associated Pumping Station, Water Treatment Works, Primary Pipeline to Maseru, Secondary Pipeline to Mazenod, Roma, Morija and another secondary Pipeline to TY. The construction is being carried out by various contractors.
These contracts are financed by the Millennium Challenge Corporation (MCC), European Investment Bank (EIB), World Bank (WB), Kuwait Fund for Arab Economic Development (KFAED), OPEC Fund for International Development (OFID), Arab Bank for Economic Development in Africa (BADEA) Saudi Fund for Development (SFD), Abu Dhabi Fund for Development (ADFD), and own resources from the Government of Lesotho (GoL).
In order to proactively handle and settle disputes if and when they occur, the works contracts entered into with the various contractors make allowance for the engagement of Dispute Boards, (DBs) which will be appointed in agreement with the respective contractors. All of the contracts are based on FIDIC Conditions of Contracts.
The services include but are not limited to, the provision of opinion at any time the Parties so request and decisions on disputes that may arise between the parties and that are referred to the DB for resolution. The services of DBs will be for the above noted contracts with the exception of the water treatment works contract and will be required until the end of the Metolong Dam and Water Supply Programme. Construction is planned to be substantially completed by the end of 2013. The defects notification period is expected to end around August 2015 for the electro-mechanical equipment installed in the project and a year earlier for the rest of the construction.
The Metolong Authority intends to establish a list of qualified potential Dispute Board members and now invites eligible qualified persons to indicate their interests in providing this service.
Applicants shall have the following minimum qualifications and experience:
i) Be fluent in the language of communication of the four major construction contracts which is the English language,
ii) Be a suitably qualified civil engineer acquainted with legal contract issues or lawyer acquainted with construction contracts and who has been registered with a professional body for a period longer than 15 years,
iii) Be experienced in the type of work which the contractors are to carry out under the four major construction contracts,
iv) Have involvement in construction projects exceeding US Dollars 40 Million
v) Be experienced in the interpretation of the construction contracts documentation,
vi) Have previous experience as a member of a Dispute Board or as a Dispute Review Expert on a similar project or as member of arbitration panel; and
vii) Member of a group of adjudicators or arbitrators will be an added advantage.
Qualified persons must provide their detailed CVs clearly demonstrating that they meet the above criteria.

An Expression of Interest must be submitted in one original and three copies in a sealed envelope to the address below, on or before Thursday 31st of May 2012 at 11:00 local time clearly marked ‘’Expression of Interest for Services of Dispute Board for the Metolong Dam and Water Supply Programme.’’
Electronic submissions (using a single pdf or other protected file) are also encouraged and should include as their message subject ‘’Expression of Interest for Services of Dispute Board for the Metolong Dam and Water Supply Programme’’ and should be sent to info@metolong.org.ls on or before the deadline for submission.
